1. Use of the Platform

You may use the Platform only if:

• You are at least 18 years old or the age of majority in your jurisdiction.
• You have the legal capacity to enter into a binding agreement.
• You comply with all applicable laws and these Terms.

You agree to use the Platform solely for lawful business or educational purposes. You may not use it for:

• Personal, malicious, illegal, or exploitative purposes
• Activities that could harm individuals, businesses, or society

2. User Accounts

To access certain features, you must create an account. You are responsible for:

• Keeping your login credentials secure
• All activities under your account
• Promptly notifying us of any unauthorized access or breach

We reserve the right to suspend or delete accounts for violations of these Terms, misuse, or security risks.

3. AI Agents and Automation

Our Platform allows you to create AI agents to automate communications, analytics, or processes via integrations with services such as Facebook, Instagram, and internal tools.

By using this functionality, you agree that:

• You are solely responsible for your agents’ behavior and outputs.
• You will not create agents that produce harmful, false, discriminatory, or illegal content.
• AI-generated content may not always be accurate and should be monitored by humans.

We provide moderation tools and built-in safeguards to promote ethical use.

4. Third-Party Integrations

When connecting to external services (e.g., Meta, Facebook Messenger, Instagram, Supabase):

• You grant us permission to access, store, and process relevant data within the scope of your authorization.
• You must comply with the terms of those third parties.
• Revoking access may impact Platform functionality.

We will never use your data beyond your explicit consent.

5. Fees and Payments

• Some features require a paid subscription. All pricing and renewal terms are clearly stated before payment.
• Payments are billed in advance and are generally non-refundable unless required by law.
• Failure to pay may result in account suspension.

6. Intellectual Property

The Platform’s technology, branding, and content are owned by Atomiq or its licensors. You may not:

• Reverse engineer, copy, or resell any part of the Platform
• Use our branding without written permission

Your own data, content, and AI agent designs remain your property.

7. Data & Privacy

• Use of the Platform is subject to our Privacy Policy, which describes how we handle your data.
• We implement strong security measures but cannot guarantee absolute protection.

8. Limitations of Liability

To the fullest extent permitted by law, Atomiq is not liable for:

• Losses caused by AI agent behavior or third-party integrations
• Business interruption, lost profits, or data loss
• Indirect or consequential damages

The Platform is provided “as is” without warranties of any kind.

9. Termination

We may suspend or terminate your account if:

• You breach these Terms
• You misuse AI in harmful or unethical ways
• We have reasonable cause to protect our Platform or other users

You may close your account at any time. Your data will be handled per our retention policy.

10. Modifications

We may update these Terms periodically. We will notify you of significant changes. Continued use after updates means you accept the revised Terms.
